I had a soft LUD on my+spouse 485 application today. I am current for this sept but will not be in Oct. Since there are no visa numbers available, I am guessing this must be either a potential RFE or my previous company lawyers may have withdrawn my G-28 representation
Does anyone know if before an RFE , would they or did they get a SOFT LUD, is this common?
Also if my previous attorney withdrew G-28 forms, will this also result in soft lud?

I am in 6th year of my H1B. It is expiring in Aug 2011.
Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.
Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

Hi,
I am on Adv-Parole (with EAD) and planning to visit India in July 2010.
I know that UK and France require transit visa, but I was wondering whether I can fly via KLM (Amsterdam) OR Lufthansa (Frankfurt) without any transit visa ?

dear friends,
I am on H1B. my wife is on H4. I want to apply ITIN no for my wife.
Q1. should i file under "Spouse of U.S. citizen/resident alien" or "Dependent/spouse of a nonresident alien holding a U.S. visa".
Q2. what are the documents I need to submit with the W-7 form.
Q3. is ITIN application only possible during tax return filing or I can apply and get the ITIN number early and then use it during my tax filing.

1. Send all AOS forms and proof of pregnancy from the doctor. They will issue RFE or you can send medical after the delivery. Don't take risk while on pregnancy. RFE reply will get 30-45 days time.
2. If your current visa is not expired, you can delay in filing I-485. Just file I-130 now.

Hi,
There seems to be a lot of mixed information about F1-OPT and I-485.
My wife is on a F1 visa. She will be finishing school soon. She also has a pending I-485 linked to my application and an "approved" EAD.
Can she apply for OPT?

Hello All,
I have couple of questions regarding Travel Document or Advance Parole.
My EAD has already been filed by my Lawyer but she is charging too much for filing Advance Parole or Travel Document,so here goes my questions.
- Is there a way to file for Travel Document myself, without involving the lawyer and if yes how can i do that
- Do I need to wait for my EAD Receipt being sent to me before filing for Travel Document.

Actions speak louder than words. If they are deeply concerned then they should be taking steps forward to make something happen.

My AP document expired in NOv 2008. I traveled to India and got back in Aug 2008. The officer stamped the document and wrote paroled until Aug 2009.
Can I travel on this document?

If you have AP, I dont see an issue. Just take a copy of your I-485 and I-797...That should be enough....Also quickly print your last two paychecks.
I travelled with AP and a copy of I-485 receipt....Nothing else....

My friends company is considering to send him to Canada for some consulting assignment.
All other people in the department are USA Citizens.
I was wondering what Visa would my friend need to work in Canada.
I ask , as USA citizens may have different rules than Indian Citizens , to work in Canada.
Does anyone else have any experience with this ?

It is a well known fact that the h1-b bodyshoppers/IT consulting companies exploit the system(laws) and their employee's for their own ends.
When everyone knows that these body shoppers are filing all the 65k h1's in one day for the jobs that are non existant with them, why no one is questioning it ?
These companies are not only grabbing all the available quota of h1's for locking in the techies(employees) and exploiting them but at the same time depriving the actual real companies (where work is done) from hiring the h1b techies.
Am just amazed at this pesudo demand of h1b created by these cyotes, isnt there any law to prohibit such malpractise/ cheating of the system ?
Also how can Attorney's and Law firms help in filing these made-up h1's are not they under oath to not do such malpractise ?
