A rather alarming report, detailed in the Los Angeles Times (http://immigrationvoice.org/www.latimes.com/news/local/la-me-customs-audit-20101228,0,2191445.story), shows that new travel restrictions requiring passports for American citizens to reenter the country are not being enforced.
These are American citizens, so perhaps we should not get too excited about the report, but it still makes you wonder about travel enforcement in general. Here are excerpts from the article:
Despite new travel requirements, more than 2.3 million Americans reentering the country by land or sea from Mexico or Canada failed to produce a passport, birth certificate or other secure document to establish identity and nationality, a government review has found.
Most people, including about 500,000 in California, were allowed to pass through ports of entry without the approved documents or without being sent to a secondary inspection post for a more in-depth examination, according to the report by the inspector general for the Department of Homeland Security.
Many travelers were allowed to pass after undergoing extensive questioning and producing at least a driver's license, the report found. Overall, 96% of travelers arriving at the 39 busiest land ports were in compliance with the new law, which took effect in June 2009.
The procedure for processing those without the required documents needs to be more precise and implemented across the board, the report said.
The Western Hemisphere Travel Initiative, approved by Congress last year, requires U.S. travelers reentering the country from Mexico or Canada to present documents, such as a passport or birth certificate, to U.S. Customs and Border Protection officers.
Out of more than 1 million people, including U.S. and foreign citizens, who legally enter the United States each day, about three-fourths arrive by land from Mexico or Canada, according to U.S. Customs and Border Protection officials.

I was in united states for 5 years and 2 months on H1-B visa. I did not apply for green card during my stay and had to return to India in Aug'2008 due to personal reasons. I want to find out if I am eligible for applyng H1 in this year's quota through same employer with whom I had earlier H1.
Here is my situation -
1. My H1-B petition is valid till 12th July 2009. My passport is not stamped to reflect this date.
2. I came back to India for good on 31st August 2008.
3. If I go back to US before 12th July, I will only get extension for remaining 10 months (as I was in us for 5 years and 2 months). But I want to go for couple of years, so have to go on new visa after completion of 1 year in India.
So I want to check if I am eligible for filing H1-B in this year's quota through same employer ?
If you physically live outside US for 365 days or more, then your H1B visa time will reset, however, your new application will be subject to cap; i.e., if your application is not picked up in the lottery, you will not be able to work. Note that if you apply for new H1B, it will start from Oct 1, 2009. The employer -- a new one or the old one -- is immaterial in this calculation.

I was thinking of local office visits only. If you are from MD, then we can go together to visit the Senators in Baltimore or Hagerstown.
I am from the 6th district and my representative is Roscoe G. Bartlett. He has an office in Frederick and I will try to meet him there.
I have not decided when to visit. May be in a couple of weeks.

I have met with staffers from offices of both MD senators a few times (in their DC offices) and I have been to the DC office of my local Congress woman.

What annoys me, is that the consulate delays the visa stamping and also keeps the passport. Seems to me that they deliberately keep the passport so that the candidate doesnt travel back on the AP. I was in similar situation in March 08 at the Mumbai consulate, after waiting for around 45 days I travelled back on the AP(back then they had not taken my passport)

If u have valid H1 visa stamped why use AP?
But any ways, here the deal.
My wife recently travelled on AP she had an expired H4 visa.Port of entry atlanta.
Here is what you need
1) 485 reciept notice(she carried orig and copies-but nobody asked for them)
2) AP's in original "and" couple of copies wont hurt
3) Your passport

You think the quota this coming year will be exhausted on 1st April itself? Or do you guess that its going take longer, if not as long as this past year?
my guess would be its going to last a few months again. Not as long as 2009 (ie. not till Christmas) but definately not on the 1st of April.
The H1 usage is a good reflection of the economy and the rate of hiring. Both have been bad, are expected to still be bad till April and only slowly start to pick up. So demand will be more than this year because:
- economy is expected to better, hiring is now slowly starting.
- many companies who were prevented from hiring H1s under TARP limitations are now out of TARP (this applies to the finance sector on the east coast, not so much to the west coast IT companies).
the only thing that could push down demand if there is some kind of immigration change like the ones that Sen. Grassley etc have been pushing for, trying to make H1s more restrictive.

Celebrating the good news here.
Question: Did anybody receive confirmation about their AOS applications being returned after filling in early July (Say on the 2nd or 3rd)? I know there have been rumors about a few returned applications but I haven't actually found anyone in such situation + my attorneys confirmed today that USCIS specifically instructed not to return/reject them.

HI,
i have two questions
I completed my Masters and working in related field(Software) from 2 years in OPT,now i got admission for Doctoral Program in UNVA(University of northern Virginia). This is not a good University, but i can complete my Doctoral Program in 3-4 years while i will be working in my related filed of study on CPT.
1Q.)can i be eligible for EB1 with this Doctoral Degree (or) Do i have to submit any international research papers for being eligible for EB1?
My F1 Visa was expired long back ,but have valid OPT and I-94(D/S duration of Study) so i can still work.
But i will be travelling to INDIA in May and will go to consulate for my F1Visa.
If i'm not satisfied with this Doctoral Program ,i will transfer to MBA with in same university (or)some other good university (i.e i'm trying to change from software to MBA).
2Q.) Can i Transfer to MBA when i got my visa for Doctoral Program in Software Engg ?
Please let me know if you need any more information (or) if i have to be more specific about the question.

Can i work while this is under process or should i use EAD?
The reason for H1 extension rfe and subsequent denial was lack of End Client Letter of contract for another 2 years.
Should i be using EAD to work and abondon H1?
Will there be any problems for 485?
Your advise is hightly appreciated. Please help
