Infact I got a call from US Consulate and they said the same thing to me, and they offered to cancel the appointment for me.

I did get the appointment thru some agency and was wondering if they played a trick but the agency vehemently denied doing any such thing,

I had a Toronto appt as well.

However not sure if it was an official call or a prank

I have an appointment in Toronto next month and today I got a voice message from the US embassy in Canada saying that there could be processing delays of days or months and the decision will be taken by the visa office during the interview. Has anyone else got this kind of message?

There should be no issues if you are taking her GC along with you, thats all she will need. She can enter with GC. No need to even mention AP to the CBP officer

If they do approve your I485, you still have 180 days to file your dependants. It is called "Follow to join". Do a google search on "Follow to join greencard for spouse".

Hi All,

Please help me to take proper decision.

I am working in US on H1B visa and my employer is ready to file for my GC in EB2.

Secondly, my father is a Green card holder and can apply for citizenship in early 2010. I have following questions:

Please note I am unmarried

1. If my father applies for GC for me under F2B can it be converted to F1 when he becomes citizen? if so, will the priority date be same or it will be new once converted to F1 category.

2. Can I apply for both family based and employment based in parallel? if it is not possible which path should I select? Will the employment based GC will be faster of family based? Its tough to decide in this economic times as we dont know how long our job will last.

Would appreciate your help and suggessions.

You can use your eb3 EAD.

But first to get into EB2 category, you have to first file another separate labor with a different employer (w/same employer it will most likely rejected) and then file 140 separately agian and then once your 140 is approved get it interfiled and then port from eb3 to eb2.


Thanks. I understand the chances are slim but I am willing to take the risk since My company has already gone through the recruitment process...Worst I still going to be on eb3...

Another question...By moving to a diferentt positon I am invoking AC21 even though it is in the same company...but at the same time I am filing for eb2 where job duties has to be atleast 50% different. This then violates ac21 rules so how come this is allowed. Most people convert from eb3 to eb2 using h1b but I am not sure if it is possible using ead

My take on this issue is that , for a non-profit institution the minumun wage determination for LCA is not based on the market rate but infact depends on the internal salary rate for the employees in the same organization at similar levels .

Is there a time limit for one to travel on Advance Parole. I was told that if a person travels abroad and intends to enter using AP, the maximum time allowed is 6 weeks, is this true?

Hey, my friend just got admission in a college and since she is not a US citizen or permanent resident. So, she needed a co-signer who is one but unfortunetly she couldnt get one cuz no one other then your own family member will trust u and sign and affidavit or co-sign a loan. Now her aunt who came with her husband on his work visa,been living for 9 yrs, recetly went out of status(I dont know the reason as its personal) has bank account and of course some savings. So my friend's aunt signed the Affidavit for my friend that was required by the university in order to process the student visa. Now after the application is filed, my friend is worried and maybe you can help her answer the questions. Her english isnt so good so Im going this for her(thu mine is bad too :)

-I do know one thing that if a person getting a student loan is not a US citizen/permanent resident she/he would need a co-signer who is one and I also know that for sure that the loan agency check the credit history of a co-signer. SO,since my friend's aunt isnt a permant resident or a US citizen(she is out of status in fact) so she cannot be my friend's co-signer for the student loan BUT what about Affidavit?
do the Immigration check the backgound of the person who signed the Affidavit,attached with her bank statments, for the student visa process or they mainly will check the student's background? my friend is concerned as she doesnt want her aunt to be in any trouble!

But I feel sorry for fellow EB's who got rejected because few IO did not know about the AC-21. I get really :mad: P***** O** to see that ppl who are playing by rule have to face hardship at freak'n every stage of GC.

I work in a private firm (<300 employees) and they have filed for PERM and is under audit. What would happen to my PERM if a bigger firm takes over my smaller company.

My H1-B 6 yr limit will expire by January 2010. What are the risks to my immigration status if my company is acquired by a bigger firm?

1. Will I have to re-file for PERM again with the new company?

OR

2. Can I continue under the already audited PERM in smaller company's name?

my spouse AP was approved last friday also from NSC and we recd the document just yesterday.

Last week friday my advance parole document from NSC was approved & sent , but we have not received the approved document yet.

Does anyone know how long it will take to receive the AP document once it's approved? We have a travel plan sometime next week.

Me and my wife are July 2007 filers. We applied for Ead renwal.
My wife started her own business and opened a LLC.
Which means she is using her EAD. But how does the USCIS know that she is using her EAD.
My question is when she aplied for the business license , she has given her SSN everywhere but how does the agencies know that this particular person is using EAD

AFAIK they dont know unless USCIS issues an RFE for tax returns. What was her status before she filed her 485?
Also why are you concerned whether they know or not?

Dear fellow IV members,

I was just referring to my first application for EAD filed by my lawyer (july filer)

For Q#12 - Date of last entry into the US - my lawyer had entered (05/10/2007) - the H1-B approval date in date of last entry in to US - is this because of the new I-94 attached to H1-B approval notice?

But the I-94 in the passport shows my actual physical entry into US after my last visit outside the country - 08/10/2006.

I have not traveled outside the country after renewing my H1-B.

Which date did you guys put - the actual date of physical entry or the I-94 start date after renewal of H1-B?

Hi,

Here is my current Status :

I485 : Filed in July 2007
PD : April 2006
EAD : Valid till 27th August 2010 (filed for renewal last week)
AP : Valid till Jan 22nd 2011
H1B : Valid till Jan 22nd 2011

My employer is still the same who filed for my GC (and helping me keep my H1 current) Last couple of time when I went to India I have used AP to re-enter the US. My wife used her EAD to get a job locally - but now she has quite and she is in India. . I am currently in process of getting my H1 stamped on my passport, get H4 for my wife and son (who was born on July 30 2010 in India)

MY QUESTION IS : What should we use to re-enter the US ? AP or H1/H4 ?
Will my H1 and EAD still be valid ? or will I lose one of them ?

Please let me know. I do not want to take a wrong step since I am so close to getting my GC.

I had my H1b till Nov 16, 2010 with Company1

Company2 applied for H1b transfer and it was approved as of Nov 08, 2010 ( but we didn't get any notification about it it's approval until few weeks later)

Company1 filed for H1b extension on Nov 10, 2010

I properly resigned Company1 on Nov 30, 2010 and started working with Company2 on Dec 1, 2010

Somehow Company1 didn't terminate my H1b extension and it got approved as of Jan 18, 2011.

1) Which status am I in? What decides my status?
2) Can I continue working for Company2 without any problems? Has this new approval put my transfer in jeopardy?
3) Do I need to update Company2 about Company1's extension approval?
4) Do I need to leave the Country to do any stamping?

Please help!!

You can have multiple H1B visas at a time ...no problem..... both your H1B's are valid
you can work for both employers at a time if you can :)
