On EAD you can work multiple jobs, accept payment or stocks or compensation from any employer.

By the way, in H1B you can accept "profit on passive investment".

Alright so it is better then i dont take any equity at all untill i get greencard?

what if i come on EAD ?? does it effect anything or still the same result ??

I have a similar timeline - applied for LC in February 2002, got approval in December 2003, filed I-140 in February 2004, I-485 in March 2004. Currently filing for my fifth EAD! The USCIS not only tortures the whole family (it's a common practice that name check is pending only for primary applicant) but makes us to pay for the wait! My son was born around the time we filed for adjustment of status, he will go to school soon but we are still not sure whether we will be allowed to stay. We cannot plan ahead and open education funds for our children. My wife cannot go to college, as she is not eligible for in-state tuition discount. Needless to say, I am forced to sacrifice my career as the whole thing is dragging for 5+ years and I have to work at the same position to keep GC process alive. I've got MCSD certificate and outgrew my position long ago. I cannot quit my job and found a new business.
The USCIS explains the delay by national security interests, but the national security requires the very opposite - speedy processing of the background checks.

What you mean by "Becareful..lot of screening is going on in PERM"?

You mean in ALL PERM or in EB2 PERM.

My lawyer is very scared to file my new case under EB2 PERM. His opinion is we may get an audit.

I have already EB3 PERM/I-140 approved. And now looking to file EB2 PERM with Bachelors+ 5 year Exp. (due to degree evaluation issues I am not able to file under Masters + 6 month exp).


Ok, I also have one Tradional LC (from Texas) and one RIR case (from MN) pending in BEC.

So the new case will be my 4th case.

I am in a very Bad situation it seems, please help.

I am working in US on L1B visa and Wife on L2. then Wife got a Job and her employer filled her 485.

In the mean time I applied for H1 (through a consultant, to get out of the L1B company). Looks like the H1 Got Approved. Now, I think the problem is, If I switch to H1, then she will loose her job and our chance of Getting EAD will go.

I do NOT want to go for H1, but EAD Is important to me. Is there a Way I can keep my L1? (so that my wife can keep her job)

Please help

Check your H-1b approval notice. If it is a visa to be issue abroad petition,then you have nothing to worry about.

if it is a change of status approval with an I-94, then you need to get out of the US on or before the day the change of status becomes effective and then return back to the US on or after the day the change becomes effective with your current L visa.

I have a approved I-140. Applied for 3 year H1 extension in Oct 2006. 3 year H1 extension approved on 5th Feb 2007. Received H4 dependents extensions. Did not receive my I-797. Requested my consulting company to check why I did not receive my I-797 with I-94. They lied to me that they called USCIS and I/they/lawyer will get copy in 30/45 days. My MN drivers license got canceled/suspended on 04/24/2007 because I did not submit approved I-797/I-94. Company lawyer informed my company that they applied under premium processing for duplicate copy on 04/16/2007. I called USCIS and they told me this is bullshit. There is no premium processing for duplicate document. Lawyer does not want to reveal which form he filed for duplicate document. I also applied this week using form I-824 for duplicate copy of approved H1 extension. Called USCIS, and they said I will get a receipt number in 15 days and copy in 2-3 months. This copy will not include I-94, so it is useless. What options do I have. My lawyer is an American and he thinks it is below his dignity to answer my calls.

What options do I now have? Any options will be appreciated.

I think you can file Form 120 for a duplicate I 94 in case it is lost/mutilated etc. please check USCIS website. hope this helps

I am in 6th year of my H1B. It is expiring in Aug 2011.

Here are some details:
- My I-140 is approved with a priority date of Aug 2006 under EB2-India.
- I did not apply for I-485 so I do not have a EAD.
- My wife is also on H1B which expires in Aug 2012.

Here are my questions:
1) If I apply for H1B extension in July 2011 under regular processing and assuming it takes 4-5 months for USCIS to process the application, can I still continue to work? For how many days can I work if visa renewal is still in processing after the visa has expired.
2) If I get a denial of H1B extension do I become out of status from the date of denial or from the day H1B got expired?
3) If I get a denial of H1B extension can I immediately apply for H4 as a dependent to my wife's visa without any issues?
4) If I get a denial of H1B extension, what happens to my I-140? Is it automatically invalid?
5) If I do convert to H4 status and my priority date becomes current can I apply for I-485?

Chances are very high that your priority date will be current before Aug 2011.

I have been filed in EB2 with a priority date of Feb 26 2007.
What you guys think about the possibility of my PD getting current this year?
I know that it needs a crystal ball to predict such horrendun things like PD movement, but I am just trying to get a poll on the general feeling about the spillover this year.

Recent memo from USCIS and 485 for does suggest that intial evidence is must. But this does not mean automatic rejection. I will suggest to wait till you get the receipt.
If you are worried about getting EAD then I don't think that should be an issue as USCIS is not going to discover till they start working on your case.
But this has to be corrected and hopefully, if dates become current for you in future, you just send an amendment.

clarify21: You can not have two status (ead & h1b) at the same time. Either your are on H1B or EAD (Pending AOS). If you would like to maintain the H1B status, for the part time job, you will have to ask your part time employer to do the new H1B; by having two H1Bs you can work for two employers the same time. By doing this, H1B and EAD both are valid. The moment you use EAD, your H1B status is invalid. Have a talk with your attorney. Hope this helps.

1. Which location i need to mentioned as primary ,home or where company located?

The LCA should list the job location as your home address.

2. Which state should the payroll runs where i live or where my seat is located?
It doesn't matter for immigration purposes.

Politicians are used to pander to their audience.
All he did was to use some keywords - "strategic alliance"; "peace"; "fight terror"; "immigration reform" etc.
He needs to list out the specific issues that he thinks are issues; and then propose a solution that would not only fix the said issue, but also prevent it from recurring.
Broad statements don't mean anything. Everyone knows the immigration system in this country is broken. But no politician has listed out (nor acknowledged) the root causes of the broken system.

But unfortunately, being a politician, he will not say anything that would put him in a corner.
